This site aims to explain Alabama probate and estate law in plain language. It covers topics like opening an estate, will contests, fiduciary duties, trust disputes, creditor claims, and probate litigation procedure.

The posts are written for Alabama residents, fiduciaries, beneficiaries, heirs, and lawyers who need a clear explanation of how Alabama law works in practice.

I write about the law as it is, not as I think it should be. I explain what Alabama statutes say, what Alabama courts have held, and how those rules apply in real situations.

I’m an Alabama probate and estate lawyer. I represent personal representatives, trustees, beneficiaries, heirs, creditors, and other parties in probate and trust disputes across Alabama.

Who am I?

I am Alan Duke. I handle contested estates and trusts. That includes will contests, trust disputes, fiduciary removal actions, breach of fiduciary duty claims, and creditor disputes. I also represent parties in guardianship and conservatorship proceedings.

Most of my work involves litigation. I represent clients in probate court, circuit court, and appellate courts. I also teach Trusts & Estates and Alabama Probate at Birmingham School of Law.
